Terms and Conditions;
All use of the site and any orders or subsequent purchase of goods or services (as defined below) from Valley Optics Direct shall be governed by the following terms and conditions: Terms of Use Licence and Site Access Valley Optics grants you a restricted licence to access and make personal use of the sites contents and not to download or modify any portion of it at any time. This restricted licence does not include any resale or commercial use of this site or its contents, including any images; for the benefit of another merchant; by the use of whatever means.
By submitting your order to Valley Optics you confirm:
You are aged 16 or over and are not registered blind or partially sighted;
You are in possession of a written prescription for your spectacles that has been given to you by a suitably qualified person in the last 24 months (or 12 months if you are aged 70 or over); and
You will supply accurate details of your current prescription (including any notes on the prescription)
You accept responsibility for entering your prescription details correctly onto the site - and if in any doubt - will contact our customer services for advice - or fax/post your prescription details to Valley Optics.
Orders for Goods;
Orders to Valley Optics must be submitted either via the web at valleyoptics.co.uk, or by telephone on 0845 2666520 Submission of an order represents an offer to purchase goods from Valley Optics, and we may confirm receipt of this offer via e-mail (if the order is placed via the site) or verbally (if the order is placed via telephone). Prescription glasses orders are only accepted by us once your payment has been processed and they have been reviewed and authorised by a qualified Optician. In the case of the non prescription goods your order is accepted once the required payment has been accepted or when the relevant goods are shipped, whichever occurs first. We will confirm acceptance of your order via e-mail or verbally.
Electronic Communications
Please provide correct Email information at the time of ordering - we communicate to you via E Mail - and any queries regarding your order will be attempted via Email initially. When you visit valleyoptics.co.uk or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically - we will not supply your details to any third party. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

 “We” / “Us” / “Our” refers to Valley Optics, “You” / “Yours” refers to the Customer.
The Contract
These terms of sale apply to all products, services or merchandise (hereinafter known as “goods”) or other saleable items specifically supplied by Valley Optics. No contract exists between you and us for the sale of any goods until we have received and accepted your order. An acceptance of your offer to buy the goods will be sent shortly after your order. However, we do reserve the right to terminate the contract in the event that the goods are unavailable, mis-priced or cleared funds are not received. The contract is subject to your right of cancellation (see below). We may change these terms of sale without notice to you in relation to future sales. However, such changes to these terms and conditions will be posted to our website.
Product Images
Product images are for illustrative purposes only and may differ from the actual product - colour variations are typically due to colour renedering differences with computer software.
Limitations of Supply
We will make a reasonable effort to ensure that all orders are fulfilled; however we cannot guarantee the availability of goods. If the goods you have ordered are unavailable, we will attempt to contact you to give you a choice to receive an alternative or a refund. If we are unable to contact you, your order will be cancelled and you will be given a full refund. On the advice of our qualified Opticians, we have absolute discretion as to whether or not to accept your order. The goods are subject to availability. If on receipt of your order it is deemed that the goods you have ordered will not become available in a reasonable time, we will notify you. We aim to dispatch most products within 1-2 weeks from the order date - however, occassionally some products may take up to 28 days.
Prices stated at checkout are inclusive of any Value Added Tax (VAT) that may be required to be remitted to tax authorities by Valley Optics. Every effort is made to ensure that prices shown on our website are accurate at the time you place your order. If an error is found within 14 days of accepting your order, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order. If we do not receive an order confirmation within 14 days of informing you of the error, the order will be cancelled automatically. If you cancel the order, or if the order is cancelled automatically due to the expiry of the 14 day period, we will refund or re-credit you for any sum that has been paid by you or debited from your credit or debit card for the goods.
Delivery and Carriage
You will be notified by email at the time your goods are dispatched. Delivery of the goods will be made to the address provided by you at the time you placed your order - via Royal Mail 1st Class Recorded delivery (UK), Airsure or International Signed for (overseas) If your goods are not delivered safely within a reasonable number of days of you receiving notification of dispatch, you should contact us. Customers should promptly inspect goods delivered to them to satisfy themselves that any goods delivered to them are as expected.
Non-Delivery / Damaged Goods
In the case of non delivery, or damaged goods - we will re-supply your order - and make a claim against royal Mail for non - delivery or damage - for which you may be required to give assistance for the claim. If you have provided a University address/business address or another address whereby other sources may sign for your order - you are accepting that the order has been delivered and in good condition.
Product Warranty
All goods supplied by us are warranted free from defects for 12 months from the date of supply (unless otherwise stated). This warranty does not affect your statutory rights as a consumer. This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by us, failure to follow the Supplier´s instructions or any alteration or repair carried out without the Supplier´s approval. If the goods supplied to you are damaged on delivery, you should notify the us in writing via e-mail: info@valleyoptics.co.uk or phone 0845 2666 520 - and we will require the returned item within 7 days from you originally receiving the item. If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify the us in writing via e-mail info@valleyoptics.co.uk or phone 0845 2666 520, as soon as possible, but in any event within 14 days of the date you discovered or ought to have discovered the damage, defect or complaint.

Copyright and Trademarks
The site’s design, names, text, images, graphics, logo are all owned by, or licensed to, Valley Optics. They may not be reproduced for any commercial or public purpose. The “Valley Optics Direct” name or logo or any other registered or unregistered trademarks displayed on the site may not be used without the prior consent of Valley Optics. These Terms and Conditions of Sales should be read in conjunction with Valley Optics Privacy Policy. Your statutory rights are not affected. For more information about your statutory rights, please visit the Department of Trade and Industry’s Consumer Gateway website at: www.consumerdirect.gov.uk.
Your right to cancel Under the United Kingdom’s Distance Selling Regulations;
You have the right to cancel the contract for the purchase of any Non-prescription product at any point from the time of ordering until seven working days after delivery. Prescription orders - are classed as bespoke 'made to order' items and are not covered by the Distance selling Regulations. Please see our full returns policy for such items. If we have already shipped your order, you will need to package the items and send them back to us, in their original condition -with all literature and product iformation sent in the original packaging. If we do not receive the item back from you, we may arrange for collection of the item from your residence at your cost. We will refund the relevant part of the purchase price for that order as soon as possible, and in any case within 30 days after we receive your notification.
The goods are at your risk from the time of delivery. Ownership of the goods shall not pass to you until we have received in full (in cash or cleared funds) all sums due to us in respect of the goods and all other sums which are, or which become, due to us from you on any account. We shall be entitled to recover payment for the goods even though ownership of any of the goods has not passed from us.
General Disclaimer of Warranties and Limitation of Liability
Valley Optics makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials or products included on this site. You expressly agree that your use of this site is at your sole risk. Notwithstanding product warranties referred to in the Terms of Sale, to the full extent permissible by applicable law, Valley Optics disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Due to the inherent nature of the Internet, Valley Optics does not warrant that this site, its servers, or e-mails sent from Valley Optics are free of viruses or other harmful components. Valley optics will not be liable for any damages of any kind arising from the use of this site including, but not limited to, direct, indirect, incidental, punitive and consequential damages.
Applicable Law
Notwithstanding the Terms of Sale and Supply of Goods below, by visiting Valley Optics, you agree that the laws of the United Kingdom without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Valley Optics or its affiliates.
Any dispute relating in any way to your visit to valleyoptics.co.uk or any of its parts, sections or services shall be submitted to confidential arbitration except that, to the extent you have in any manner violated or threatened to violate Valley Optics intellectual property rights, Valley Optics may seek injunctive or other appropriate relief in any UK court. No arbitration under this agreement shall be joined to an arbitration involving any other party subject to this agreement, whether through class arbitration proceedings or otherwise.
